Anti-Bribery Compliance
Section 17A Malaysian Anti-Corruption Commission Act 2009 ("MACC Act") introduces corporate liability for corruption offences.
This Act criminalises the corrupt acts of a commercial organisation if any persons associated with that organisation gives or offers gratification to any person to obtain a business advantage for the commercial organisation. Directors and senior management are liable for the actions of the company if it is involved in bribery unless it can prove that it has successfully implemented adequate procedures to prevent bribery from happening.
We asssist companies in designing, implementing and reviewing their anti-bribery and corruption compliance programs to comply with S17A. This includes risk assessments, creating and updating policies, procedures, templates, and conducting awareness sessions.
Whistleblowing
An effective whistleblowing policy serves to raise concerns about possible wrong-doing or improprieties in financial or other matters involving staff and Board members. We are able to assist in setting up a whistleblowing policy and whistleblowing channels.
